Trump appeals travel ban ruling

A federal judge in Hawaii has blocked President Donald Trump's new travel ban, hours before it was due to begin after midnight on Thursday.

Chuang was also the first judge to stop the ban outside the 9th Circuit, which has a liberal reputation.

When asked by NBC later previous year if he was rolling back his Muslim ban plan, Trump responded: "I don't think it's a rollback".

Trump decried Watson's ruling at a Nashville rally on Wednesday, saying the blocked executive order was a "watered-down" version of the previous travel ban.

But the new ban has run into the same problems.

The Justice Department called the Hawaii ruling "flawed both in reasoning and in scope".

US District Judge Derrick Watson cited "questionable evidence" in the government's argument that the ban was a matter of national security.

"The illogic of the Government's contentions is palpable". "The notion that one can demonstrate animus toward any group of people only by targeting all of them at once is fundamentally flawed".

An earlier version of the order included Iraq in the targeted countries, as well as a clause that exempted religious minorities from the ban.

U.S. District Court Judge Theodore Chuang said the consideration of such evidence by a federal court a matter of "common sense", as such "explicit statements of a religious objective are "readily discoverable facts" that allow the court to identify the goal of this government action without resort to 'judicial psychoanalysis'".

The government says the ban is a national security measure and critics say it is an unconstitutional and bigoted attempt to bar Muslims from entering the country.

The hearings in Maryland and Hawaii were two of three held Wednesday in federal courts around the country. He said those suing had "not provided a sufficient basis" for him to declare the other sections invalid.

The initial ban sparked chaos at US airports and widespread criticism around the world when it was signed in January.

"Significantly, during the time period since the Reagan administration, which includes the immediate aftermath of September 11, 2001, there have been no instances in which the President has invoked his authority.to issue a ban on the entry into the United States of all citizens from more than one country at the same time, much less six nations all at once", the judge wrote.

It also says there is a "dearth of evidence indicating a national security purpose". He left in place the section of the order that barred the entry of refugees to the United States for four months.

The department claims in its filing that even though Watson's ruling suspends the 90- and 120-day bans, numerous provisions in the relevant sections of the executive order were not addressed in the briefs the plaintiffs filed in support of their request for a temporary restraining order. In a Fox News interview, Miller stated that the "basic policies are still going to be in effect".

"These plainly-worded statements, made in the months leading up to and contemporaneous with the signing of the Executive Order, and in many cases, made by the Executive himself, betray the Executive Order's stated secular goal", Watson wrote.

"Any reasonable, objective observer would conclude, as does the court for purposes of the instant Motion for TRO, that the stated secular goal of the Executive Order is, at the very least, "secondary to a religious objective" of temporarily suspending the entry of Muslims", he added.

But statements from Trump and his team, especially when combined with his continued inclusion of a 90-day ban on foreign nationals from six Muslim-majority countries, have proved - at least for now - insurmountable in court.
