43 states reach $33M settlement with Johnson & Johnson

Forty-three attorneys general have reached a $33 million settlement with Johnson & Johnson subsidiary McNeil-PPC Inc.

They claimed that McNeil misrepresented its compliance federal manufacturing rules and the quality of its over-the-counter drugs.

The settlement was announced Wednesday by attorneys general in the states.

Johnson & Johnson's McNeil Consumer Healthcare Division did not admit to violating any state law or regulation, or admit to any wrongdoing. The Food and Drug Administration found some facilities didn't comply with the practices between 2009 and 2011, according to Illinois Attorney General Lisa Madigan's office.

The settlement resolves allegations that a subsidiary of Johnson & Johnson sold various over-the-counter drugs to consumers, even though some manufacturing facilities did not comply with federal standards.

At the time McNeil-PPC paid a criminal fine of $20 million and forefeited another $5 million.

Other attorneys general issued similar statements about their tolerance for marketing metal-laden or musty meds to the people of their states and districts.

CBO's score of the initial bill unleashed a flood of criticism from Democrats, Obamacare supporters and lawmakers' constituents. The AHCA will also raise premiums by 800% for seniors who are making $26,500 or less in states requesting waivers.

"This settlement requires safeguards to ensure states get the appropriate information they need to protect their citizens if they are any future recalls by this drug manufacturer", Attorney General Shapiro said in a statement.

The alleged quality control lapses resulted in drug recalls for McNeil brands such as Tylenol, Motrin, Benadryl and Sudafed.

The settlement includes restrictions barring "inappropriate" advertising of the company's products and reporting and investigative requirements that attempt to create safeguards for consumers. Class I recalls involve a reasonable probability that use or exposure to the drug may result in serious detrimental health consequences or death.

Pennsylvania and Texas headed an executive committee that led the states' investigation of McNeil.
