California Legislature approves 'sanctuary state' bill

President Donald Trump did not release his tax returns during the 2016 presidential campaign

The bill, known as SB54, bans law enforcement officials from asking about the immigration status of people under arrest, and prevents local police from being "deputized as immigration agents", The Associated Press reports.

The measure cleared the Legislature with support only from Democrats over the objection of Republicans who it will protect criminals and make it harder for law-enforcement to keep people safe. Jerry Brown worked with lawmakers to scale back parts of the legislation, which would have previously forbade federal immigration officers from questioning inmates in county jails.

Some immigrant rights advocates who were previously disappointed with the list of offenses under the Trust Act, were dismayed to see the same exceptions applied in the so-called sanctuary state bill.

Brown has backed the bill and is expected to sign it into law, despite the Trump Administration rejection of sanctuary cities and states.

The CM's reaction comes at a time when the Ministry of Home Affairs has alerted states to identify and monitor "illegal migrants". The government's draft affidavit says there is no "violation of fundamental rights of the petitioner" in this case.

But amendments added this week would permit officers to continue sharing information and transferring people for immigration authorities if they have convictions for one or more of roughly 800 crimes.

But Republicans warned their colleagues that the legislation was risky and unnecessary, making it harder to deport criminals.

The changes allowed state and local law enforcement to communicate with federal immigration authorities if a person has been convicted of certain crimes.

IL recently passed even more protective legislation that bars law enforcement from detaining immigrants exclusively for deportation, said Shiu Ming Cheer, senior staff attorney at the National Immigration Law Center.

The California Police Chiefs Association is neutral on the bill, but the California State Sheriffs' Association opposes it.

As lawmakers considered the bill Friday another high-profile killing in San Francisco spotlighted the sanctuary issue.

Assemblyman Chris Holden, who held the measure in his Utilities and Energy Committee, said he would consider it again when the legislature returns in January for the second half of their two-year session.

"We hope that it will serve as a model for other states and encourage them to adopt similar protections", said Jenny Pasquarella, immigrant rights director for the American Civil Liberties Union of California.
